Dear Mrs. Fancher-English:
The Colorado Division of Reclamation, Mining and Safety(Division or DRMS)conducted an inspection
of the proposed mining site on November 22, 2017. Based on this inspection,the Division identified
several additional adequacy review items that will need to be addressed. These items are in addition to
the items already identified in the Division's first adequacy review letter dated November 14,2017.
During the inspection,the Division observed the Taylor and Gill Ditch. A portion of this ditch appears to
be located within the permit area along the western boundary of the mine site south of the Little Cache La
Poudre Ditch. A small ditch lateral appears to T-off the Little Cache La Poudre ditch and flows parallel
to the Taylor and Gill Ditch and bends to the east into the site. This lateral ditch appears to dead end near
the dirt road that goes to the Little Cache La Poudre ditch from the southwest entrance to the mine site.
The Taylor and Gill ditch and the lateral are not identified on Exhibit C or discussed in Exhibit S. Given
this,please address the following issues:
Rule 6.4.3 Exhibit C—Pre-Mining and Mining Plan Map(s) of Affected Lands
1. Please update the Exhibit C maps to depict the Taylor and Gill Ditch and the Little Cache La
Poudre lateral ditch. Please show the name of the owner of the ditch and lateral.
Rule 6.4.4—Exhibit D Mining Plan and Rule 6.4.5,Exhibit E—Reclamation Plan
2. The mining plan and reclamation plan does not appear to take into account the location of the
Taylor and Gill Ditch and the lateral ditch. Please revise the mining and reclamation plan as
necessary to account for these structures. Please indicate how these structure will be protected
from damage during the mining operation.
3. The Taylor and Gill ditch and the lateral ditch do not appear to be lined. Please explain how
water losses from the ditches will be prevented,monitored and/or mitigated.
