TRI-STATE GENERATION AND TRANSMISSION ASSOCIATION, INC.
HEADQUARTERS: P.O. BOX 33695 DENVER, COLORADO 80233-0695 303-452-6111
December 22, 2017
Mr. Brock Bowles
Environmental Protection Specialist RECEIVED
Colorado Division of Reclamation, Mining and Safety
1313 Sherman Street, Room 215 DEC 2r, 2017
Denver, CO 80203
Division of Reclamation,
RE: New Horizon North Mine (Permit No. C-2010-089) Mining & Safety
Permit Revision No. 2 (PR -02)
Second Adequacy Review Response
Dear Mr. Bowles:
Tri-State Generation & Transmission Association (Tri-State) has received your adequacy review
letter for PR -02, dated December 5, 2017 and provides the following responses to your comments on
behalf of the Elk Ridge Mining and Reclamation's New Horizon North Mine.
Section 2.05.4(2) (d) Overburden and Topsoil Handling Plan
1. Item Resolved.
Section 2.05.4Q(e) Revegetation
2. Tri-State is proposing to use "the current year annual alfalfa yield for Montrose County" as
the basis for the success criterion for the Garvey Property irrigated pasture. The data will be
obtained from the USDA - National Agricultural Statistics Service. The success standard
proposed by Tri-State is adequate. Although it must be noted that the `current year annual
alfalfa yield' is published by the USDA in November of the year following any production
sampling at the mine site. By using the current year data as the reclamation standard, all
future bond release applications will be delayed about I year waiting for the appropriate
data to be published. Does Tri-State want to commit to this timeline for this standard?
Response: Section 2.05.4(2)(e) have been revised to indicate that success comparison will
occur against either the Montrose Co. current annual alfalfa yield or the long term average.
Also included with this adequacy response package are materials revised in response to your
adequacy comments and a change of index sheet to ease incorporation of this material into the permit
document. If you have any questions regarding the enclosed adequacy review responses, please
contact Tony Tennyson at (970) 824-1232 or ttennysongtri state gt.org.
DJC:JS:der
Enclosures
AN EQUAL OPPORTUNITY/ AFFIRMATIVE ACTION EMPLOYER
A Touchstone Energy' Cooperative
Sincerely,
Daniel J.
