1/2/2018
State.co.us Executive Branch Mail - Fwd: Bowie Resources
office concerning reclamation of the mining related property. My concerns were about removal of
the electric transmission line across the property I was considering and the appearance of the
property across the highway. I was assured by the person I spoke with in your office that the
property would have to be reclaimed within 2 years of cessation of mining activity. That included
all structures, improvements, service lines, re -grading of disturbed soil and return of the property to
agricultural/residential use.
Based on the word out of your office concerning reclamation, I purchased the property knowing
that Bowie Resources would be finished with mining operations very soon.
Now, over 2 years after cessation of mining activity, very little has happened concerning
reclamation of the property. Not only that but Bowie Resources has tried to pull off a maneuver to
avoid reclamation via land use change through the Delta County Board of County Commissioners.
Avoiding, or even postponing, reclamation of fouled land and maneuvers to leave the transmission
line across properties whose owners were promised removal of said lines is clearly in violation of
promises made to this valley by coal companies. Not only that but it clearly defeats the purpose of
state regulations, clearly exposes neighboring property to financial damage and risks that your
regulatory agency was set up to protect against.
I am appealing to you to deny any permit changes, regulatory favor, or amendments to Bowie
Resource's mining or reclamation plans until they clean up the mess left behind by past mining
activity. I am asking you to do everything in your power to force Bowie Resources to do the right
thing. I am urging you to protect the citizens of the North Fork Valley by requiring Bowie
Resources to reclaim the land and remove all infrastructure that was placed here for mining
activities.
Please respond with an update on where your office stands and what can be expected to happen
with this land that has not yet been reclaimed.
Thank you,
Tim Austin
41339 Hwy 133
Paonia, Colorado 31428
719-333-4146
https://mail.google.com/mail/b/AAfm9zaKsiHkgJUycRl uxNvdORlxb5j6ncL2n2ej9Kr9MHuE1 JtY/u/O/?ui=2&ik=deb7fOcd20&jsver=1 QCYKmliAi4.en.&vi... 2/2
