STATE OF
Im COLORADO
Greeley Pit (DRMS Permit No. M-1977-151)
1 message
Jared Dains <Jared Dains@applegategrou p.com>
To: "eric.scott@state.co.us" <eric.scott@state.co.us>
Cc: Rex and Sharon Hiner <rmhpipeconst@hotmail.com>
Scott - DNR, Eric <eric.scott@state.co.us>
Fri, Dec 29, 2017 at 10:09 AM
Good morning Eric. I'm writing you on behalf of R M Construction Co Inc, to respond to the issues you identified during
your November 1, 2017 inspection of the Greeley Pit.
Hydrologic Balance: Since the last SWSP approval on May 7, 2015, Rex and Sharon Hiner (owners of R M Construction
Co Inc.) have acquired 3.25 additional shares in the Greeley Irrigation Company (GIC) in order to assist in meeting long
term augmentation needs at the Greeley Pit. These additional shares are evidenced by the attached GIC certificates
3413 and 3415. A renewal of the Greeley Pit SWSP is due in the coming months, and when the renewal request is
submitted these additional shares will be referenced in the plan.
General Compliance wl Mine and Reclamation Plan: Based on my reading of your inspection report, it appears that
your primary concerns are the new gas/oil facility structure located in Phase 3 of the permit, as well as the RV storage
area located just west of Phase 2.
Regarding the RV storage area: these RVs are not permanent structures and do not have an impact on Phase 2 of the
minae (which has already been mined out). This RV storage is consistent with the proposed reclaimed land use of private
recreation area specified in the original permit application. Can you clarify then how this RV storage is a violation of the
terms of the mining permit?
Regarding the new gas/oil facility. if R M Construction Co Inc. is able to provide an agreement with the facility owner that
complies with the requirements of Rule 6.4.19 (pertaining to permanent manmade structures within 200 feet of the
affected land), would this resolve your concern?
Regards,
,Jared Dains, FF -
Applegate Group, Inc.
1490 West 121$1 Avenue, Suite 100
Denver, CO 80234
Phone: (303) 452-6611
Fax: (303) 452-2759
2 attachments
Certificate No. 3413.pdf
78K
ij HinerCtf3415.pdf
468K
