The Challenger Pit SWSP was most recently
renewed on December 31, 2012 and was valid through December 31, 2014. The required fee
of $257 for the renewal of this substitute water supply plan has been submitted (receipt no.
3676884).
Plan Operations and Depletions
Mining at the Challenger Pit site has been completed and the site was reclaimed in
2004-2005. Reclamation activities created three unlined ponds with a total exposed surface
area of approximately 23 acres. Pond 1 measures 18 acres of water surface area, and Ponds 2
and 3 measure 3 and 2 acres respectively. All water surface area is exposed ground water
and there are no areas exposed due to mining activities prior to 1981. The only loss now
associated with the gravel pits and covered by this SWSP is evaporative loss.
The previous substitute water supply plan required the applicant to file for a
permanent plan for augmentation with the Water Court by December 31, 2013 to include, but
not limited to, the long-term evaporation losses. Such a plan has not been filed. You have
stated that approval of this plan will assist in proceeding to water court to obtain an
augmentation plan as well as provide a working plan until such time as the augmentation plan
is approved by the Water Court. Also, not being able to continue operating under a substitute
water supply plan until the reclamation is complete will cause undue hardship to the
applicant.
Office of the State Engineer
1313 Sherman Street,Suite 818•Denver,CO 80203•Phone:303-866-3581
www.water.state.co.us
