SAND AND GRAVEL LEASE WITH <br /> RIGHT TO ENTER <br /> THIS AGREEMENT is made and entered into this 5`��` day of <br /> 2017, by and between Lincoln County, Colorado, of 103 Third <br /> Avenue, P.O. Box 39, Hugo, Colorado 80821, hereinafter referred to as the "Lessee" <br /> and Robert J. Safranek and Rosann Safranek, of P.O. Box 970, Limon, Colorado <br /> 80828, hereinafter referred to as "Lessors". <br /> Whereas, the Lessors are the owners, as tenants in common, of the Northeast <br /> Quarter (NE1/4) of Section One (1), Township' Nine (9) South, Range Fifty Six (56) ` <br /> West of the 6t' P.M., Lincoln County, Colorado; and <br /> Whereas, the Lessee wishes to lease a portion of the above described real <br /> property for the purpose of excavating sand and / or gravel and conveying the gravel <br /> from the property for use on county roads and projects; and <br /> Whereas, the Lessee intends to transfer the State of Colorado gravel permit <br /> known as "Gaede Pit; State No. M-1978-051", to the leased property, hereinafter <br /> referred to as the "Property'; and <br /> Whereas, a diagram of the proposed area to be leased is attached hereto as <br /> Exhibit A; and <br /> Whereas, the Lessors are willing to lease the sand and gravel interest in and <br /> under the Property to the Lessee under the terms and conditions set forth herein; <br /> NOW, THEREFORE, in consideration of the mutual covenants herein contained, <br /> the Lessors do, by these presents lease and let for the purposes hereinafter set forth, <br /> under all lawful warranties unto the Lessee, the sand and gravel interest described <br /> herein. <br /> 1. The Lessee shall have the right to mine, extract, remove, and take from the <br /> above described real property all of the sand and gravel, in and under the property, <br /> along with the right to remove the topsoil to obtain access to the sand and gravel. <br /> Lessee shall also have the right to use necessary space for the construction and <br /> maintenance of any structure or equipment required for the extraction and / or <br /> processing of sand and gravel and space for stockpiling such sand and gravel on the <br /> property, all without any payment in addition to the royalties and other payments as set <br /> forth in paragraph 4 below. <br /> 2. The Lessee shall have during the term of this agreement the unlimited <br /> right of ingress and egress for the removal of sand and gravel mined, extracted, <br /> removed and taken from the property. <br />
