December 19, 2017 <br /> Colorado Division of Reclamation, Mining and Safety DEC 22 2017 <br /> 1313 Sherman Street, Room 215 <br /> Denver, CO 80203 DIVISION OF RECLAMATION <br /> RE: Permit No. M2017049 MINING AND SAFETY <br /> Ms. Amy Eschberger; <br /> I am writing to object to the latest Transit Mix Application to the CDRMS, application number <br /> M2017-049, as feir application continues to fail to protect our critical water resources, significant <br /> wildlife habitat and the easement rights of several property owners along Little Turkey Creek <br /> Road. As such, I am an aggrieved party and an interested person per CRS 24-4-102. (3.5) <br /> (6.2)(11)seeking relief per CRS 24-4-102. (14). <br /> 1 find Transit Mix's continued assertions that they will not impact the hydrologic balance of water <br /> in and under Little Turkey Creek Canyon cavalier in their disregard for the real potential to <br /> damage this canyon, our community and the surrounding established residences'water supply. If <br /> Transit Mix is wrong about the water,we lose everything. <br /> Similarly, the wildlife habitat, without water is a two-legged stool. A present, wildlife drawn to this <br /> canyon has superb habitat. It is unacceptable both in the short-term and the long term, to cutoff <br /> their water, or impede their access to this creek and wetland. Wildlife will be simply be driven <br /> away or die if they can't relocate. <br /> Finally, by Transit Mix simply saying that they don't need access to the LTC Road does not make <br /> the requirement go away to pursue a Declaratory Judgment on Little Turkey Creek Easement. <br /> They are using slight of hand, not accomplishing the courtroom resolution your Board required be <br /> resolved first. <br /> 1 appreciate their right to reapply; nevertheless Transit Mix has not changed their fundamentally <br /> flawed premise that we need or want a quarry to be put into the midst of our existing <br /> communities. <br /> Sincerely, <br /> Signed, <br /> U4,& K�� <br /> Denise M.
