See Order, R. at 4411. <br /> Based upon the evidence, the Board reasonably concluded that the measures in the <br /> Application did not adequately account for the high biodiversity significance of the <br /> area, the critical migratory corridors, or the critical habitat for the Mexican Spotted <br /> Owl. <br /> A reviewing court cannot overturn the Board's order because Transit Mix <br /> would have weighed the evidence differently. The Board's conclusion is <br /> supported by substantial evidence. While it was not necessary for the Board to <br /> make express factual findings, the Board did make findings regarding the <br /> protection and safety of wildlife, and therefore it is not necessary to remand to the <br /> Board. <br /> VI. CONCLUSION <br /> For the reasons set forth above, Ingersoll requests that the Court affirm the <br /> Board's denial of Transit Mix's Application for a 112c construction material <br /> reclamation permit. <br /> 22 <br />
