reweigh evidence or substitute its own judgment for that of an agency. Microsemi,
200 P.3d at 1125.
At the hearing, the Board heard testimony from Messrs. Steve Mulliken,
Jerry Moore, Ted Kerr, and Charles Norris regarding the effects of the proposed
Quarry on the groundwater of the subject area. See Order, Conclusions of Law, ¶
24. The testimony of Messrs. Mulliken, Moore, Kerr, and Norris collectively
established that:
(1) water for wells in the Hitch Rack Ranch area is not located in a
large, underground aquifer, but rather in the smaller fractured granite
structures, which Transit Mix proposes to destroy and permanently
remove;
(2) the Hitch Rack Ranch and neighboring areas have very fragile
wells and poor sources for water, and are primarily arid areas;
(3) the proposed Quarry will directly affect the water sources for
surrounding areas by destroying and removing the granite deposit
which is the collection system and provides the complex fractured
granite pathways that deliver the water to the wells and the stream,
thereby reducing water flow of the Little Turkey Creek which runs
through the Hitch Rack Ranch site; and
(4) the proposed Quarry will undoubtedly impact groundwater,
among other things.
See R. at 8810-12, 8813-28, 8907-12, 8912-29.
The evidence in the record indicates that the impact of removing the granite
is to potentially destroy the fractured granite aquifer. See R. at 8827-28. Transit
Mix acknowledged that the water system might be destroyed and offered to either
replace the well or supply the well owner with a cistern or supply of water.
