C. Colorado Milling Company, LLC shall, within sixty days of the <br />effective date of this Order, file with the Division a permit conversion <br />or amendment application to ensure that all lands affected by the <br />mining reclamation activities, including the Times Mine adit and all <br />aspects of the water pipeline from Left Hand Creek to Gold Hill Mill, <br />are located within an approved affected land boundary and addressed <br />by a reclamation plan and appropriate performance and financial <br />warranties. Operator shall diligently pursue and attain the Division's <br />approval and issuance of the application within statutory deadlines. <br />The Board imposes a CIVIL PENALTY of $50 per day for fifty-seven days of <br />violation for a total civil penalty of $2,850 pursuant to section 34-32-124(7), C.R.S. <br />All but $100 of the total civil penalty is suspended if Operator complies with the <br />corrective actions in the time specified. The portion of the civil penalty that is not <br />suspended, $100, shall be due and payable within thirty (30) days of the effective <br />date of this Order. In the event that Operator fails to complete the corrective <br />actions by the deadlines set forth herein, the suspended portion of the civil penalty, <br />$2,750, is due in full within thirty days of the corrective actions deadline. Failure to <br />submit any portion of the civil penalty that is due and payable by the date specified <br />shall result in immediate submittal of such penalties to state collections. <br />DONE AND ORDERED this day of 2017. <br />FOR THE COLORADO MINED LAND <br />RECLAMATION BOARD <br />John Singletary, Chair <br />NOTICE OF JUDICIAL REVIEW RIGHTS <br />This order becomes effective and final upon mailing. Any party adversely affected <br />or aggrieved by agency action may commence an action for judicial review by filing <br />a complaint with the district court within thirty-five (35) days after the effective <br />date of this order, pursuant to section 24-4-106, C.R.S. (2017) and the Colorado <br />Rules of Civil Procedure.
