BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />Notice of Violation No. PV -2017-008 <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br />IN THE MATTER OF VIOLATION OF EUSTICE ZACHER, CIVIL PENALTIES, <br />CORRECTIVE ACTION, REVOCATION OF NOTICE OF INTENT TO CONDUCT <br />PROSPECTING OPERATIONS, AND FINDING THE FINANCIAL WARRANTY <br />TO BE SUBJECT TO FORFEITURE, File No. P-2014-021 <br />THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br />September 27, 2017 in Denver, Colorado for a hearing to consider forfeiture of the <br />financial warranty of Eustice Zacher ("Prospector"), file number P-2014-021. Michelle <br />Ramirez appeared on behalf of the Division of Reclamation, Mining and Safety <br />("Division"). There was no appearance on behalf of Prospector. <br />The Board, having considered the presentation and having been otherwise <br />fully informed of the facts, hereby enters the following findings of fact, conclusions <br />of law and order. <br />FINDINGS OF FACT <br />1. Prospector holds Notice of Intent to Conduct Prospecting Operations <br />number P-2014-021 ("NOI" ). Located in Section 25, Township 22 South, Range 70 <br />West, 6th P.M. in Custer County, the site is a 1.2 -acre gold and silver prospecting <br />site known as EZ Ranch — EZ 6 Claim. <br />2. The Division holds a financial warranty for the site in the amount of <br />$4,000. <br />3. On May 31, 2016, the Division sent Prospector an Annual Fee Invoice <br />and Report Request for payment of the 2016 annual fee, completed annual report, <br />and map, all due by the NOI anniversary date. <br />4. On December 23, 2016, the Division mailed a Grace Period letter <br />to Operator. <br />5. On January 27, 2017, the Division received the Grace Period letter by <br />return mail from the U.S. Postal Service. <br />6. Prospector failed to pay the annual fees or submit the annual reports <br />and maps by the anniversary date or at any time since. <br />
