Likely Road Damage to Little Turkey Creek Road (my Decreed Easement)and
Danger to Myself, Family, and Friends from Potential Flyrock Flooding and Rock Fall on Little Turkey
Creek Road (my Decreed Easement)
Nancy and Charles Reed have described concerns and objections with which I entirely agree concerning
the easement and road, and dangers of rock slide, flooding, improper water retention, and instability of
the surrounding area. Jerry P. Moore has submitted objections about hydrology, hydrogeology, and
geotechnical issues (including analysis from Dr. Fifield)directly applicable to potential damage and
safety on the road with which I entirely agree. These issues of erosion, rock slide, flooding, improper
water retention and instability of the surrounding area place a financial burden on easement owners to
maintain the road, but they also pose a safety issue to easement owners traveling the road along with
the flyrock issue. Some of the damage to the road may result in permanent maintenance issue after
reclamation. The Hitch Rack Ranch owners have never as stated earlier contributed to the maintenance
of the road. The Engineering report that the road SHALL NOT be damaged does NOT meet the legal
criteria and Transit Mix admitted in M2016010 that the road will be damaged. Also see Nancy and
Charles Reed objections concerning this.
Damage to my current and future Wells,Structural Damage to Home from Blasting Vibration Rock Fall
or Flyrock, and Damage to Property Value
Jerry P. Moore along with Chuck Norris testimony at the M2016010 hearing(still totally relevant) and
the issues raised by Charles and Nancy Reed indicate that there is a greater probability of damage to
wells in a fractured granite water system than not. The permanent water loss on the JL Ranch when
NORAD was constructed and removed 1/80 th of the granite Transit Mix proposes removing support my
concerns. The damage once done cannot be undone and is permanent. Cisterns are a flawed and
irrational option that should not be considered. Along with the known property value loss, having a
cistern almost eliminates the ability to mortgage properties along with the bacteria and many other
issues. Add to the water issue that future wells are not even addressed in the application. If they can't
find well water do they also get cisterns? Transit Mix asserts that the Colorado Division of Water calls
the daylighting of water de minimus and that they don't need a water augmentation or replacement
plan. That is contrary to Colorado Water Law. Taking away water from persons and sending it
downstream to others is just wrong and is a disturbance of the watershed that cannot be minimized and
is permanent. Transit Mix asserts monitoring wells and models have shown that the well water will drop
10 feet. What they have shown thus far is that water runs downhill. The fracture system is so large,
complex and unmapped that what is being monitored cannot be correlated with any accuracy to wells in
the system.
Blasting vibration, rock fall and flyrock are likely to result in damage to my home that is a half mile or
less from the blasting. Safety for me, my family and my friends are at risk at my home or traveling on the
road to and from. Far more detail is needed in their blasting plans.
Damage to wildlife and Habitat
I agree with objections from The Nature Conservancy and Steve Mulliken representing the Ingersoll
Estate. James Enderson a retired Professor of Biology(Colorado College)who helped save the Peregrine
Falcon and was a world renowned Bird of Prey expert owned property in Eagles Nest. There he
