Any changes or additions to the application on file in our office must also be reflected in <br /> the public review copy. Please submit proof that the public review copy has been updated <br /> with a copy of the response to this adequacy letter. <br /> I will be sure this time to get you a copy of the proof of <br /> placement for this second go around in a timely manner. <br /> EXHIBIT S - Permanent Man-Made Structures (Rule 6.4.19): <br /> 53. In response to Adequacy Item#42, the Applicant included five executed structure <br /> agreements between the Applicant and the owners of structures within 200 feet of the <br /> permit boundary. Please provide a copy of the remaining agreements which were sent but <br /> not executed. <br /> As of the date of this letter we have not received any more <br /> structure agreement . Attached are copies of ones not executed by <br /> the owners . <br /> 54. Please note, the Division is currently reviewing the engineering evaluation submitted in <br /> accordance with Rule 6.4.19(b) for those structures where an agreement could not be <br /> reached. An additional adequacy review will be forwarded to the Applicant as soon as the <br /> review of it concludes. <br /> As we discussed, I revised the sloping plan to take out leaving <br /> the near vertical rock face and returned it back to the exiting <br /> plan of backfilling all slopes to 3h to 1V and moved the buffer <br /> zone from 20 feet to 200 feet to add a larger safety margin unit <br /> the geotechnical analysis can be completed for the closer mining <br /> setbacks . Once these are complete, and show that the stability <br /> of leaving a near vertical highwall will be safe and that mining <br /> can take place within 200 feet of the permit boundary a Technical <br /> Revision(s) will be filed to make these changes . <br /> I hope these responses have addressed the adequacy questions <br /> you had. I have included a set of pages showing the revisions to <br /> the original plans . The green highlighted area are additions the <br /> red struck out text are the portions removed. I will place a <br /> copy of this packet with the Pueblo County Clerks office as <br /> required and proved proof of placement . If you have any questions <br /> please call . <br />
