Summit Brick and Tile Company Fox No 1 Clay Pit <br /> M-1977-219-Adequacy Response#2 Page 6 <br /> I e-mailed a copy of the existing reclamation standards to the <br /> Pueblo Office of the NRCS on 12/11/17 and asked them to review <br /> and send me a revised plan. On 12/18/17 I talked to Lana Pierson <br /> and she is reviewing the 1990 information and the seed mix noted <br /> in the next paragraph and will provide us their recommendations <br /> as soon as possible . When I receive the revised recommendations <br /> I will file them with the Division for the record. <br /> 47. In response to Adequacy Item 421, the Applicant states they are working on the stability <br /> analysis to allow the final reclamation slope of the sandstone layer to be left at near <br /> vertical and in the meantime offers to commits to not mining within 200 feet of any <br /> structure until the Division has reviewed and approved the analysis. Please clarify that <br /> the Applicant will commit to maintaining a 200-foot buffer between the permit boundary <br /> and crest of the reclaimed 3H:1 V overburden and update the cross sectional figures on <br /> the Reclamation Plan Map to reflect the 200-foot buffer instead of the 50-foot buffer. <br /> Please update the Mining and Reclamation Plan Maps to reflect this buffer accordingly. <br /> Please also commit to delineating this 200-foot buffer on the ground when an active <br /> 40-acre phase is within proximity to the permit boundary. <br /> We are waiting on your approval of the Geotechnical Report <br /> submitted that determined the proposed setbacks are adequate to <br /> protect structures within 50 feet of dig line at the mine <br /> boundary. Until such time as it is determined, what the actual <br /> setback distance should be, Summit will commit to not mining <br /> within 200 feet of the Permit Boundary. Summits understanding is <br /> that if the results of the Geotechnical Analysis show that the <br /> mining buffer can be less the 200 feet a Technical Revision will <br /> be filed, should they choose to mine within the 200 feet buffer. <br /> Summit will commit to establishing the buffer line on the ground <br /> prior to mining within the approved buffer limit of the boundary <br /> for any new area. The maps have been revised showing the 200 <br /> foot buffer line . <br /> 48. In response to Adequacy Item#25, the Applicant now proposes to revert back to the <br /> following seed mixture from 1990: <br /> Looks like that was premature since Summit had committed to a <br /> seed mix prepared by Thomas Schreiner that I did not know about . <br /> So we withdraw the 1990 mix and will provide another mix prepared <br /> by the NRCS . <br /> Please note, during the review of AM-02, Applicant committed to using the following <br /> more diverse seed mixture: <br />
