I used this <br /> map to properly locate Evan Road on all of the maps without <br /> changing the boundary or the number of acres in the permit and <br /> have [provide revised copies . After our discussion Summit Brick <br /> decided not to create a haul road that leaves the mine in the <br /> northwest corner. I have removed it from all of the maps so an <br /> amendment does not have to be done to add the road area to the <br /> permit . <br /> 43.3 It appears there are now additional structures (driveway and out-buildings) within 200 <br /> feet of the affected lands located on the property identified as Boyd D & Janette L Rider. <br /> The Applicant must now comply with Rule 6.4.19 for these additional structures. Please <br /> note, although the Applicant attempted to obtain an agreement for a fence owned by these <br /> individuals, the Applicant will now be required to attempt to obtain an agreement for the <br /> additional structures in accordance with Rule 6.4.149(a)prior to complying with Rule <br /> 6.4.19(b). <br /> The new structure (driveway) you note is not within 200 feet of <br /> the existing boundary since the permit boundary was not changed. <br /> I have revised all of the maps to reflect the proper location of <br /> Even Road and the existing access road added in Adequacy Response <br /> #1, including the photo insert in Map Exhibit C-3 . I found that <br /> I left a structure owners name off the main map (Daniel & Cheryl <br /> Hanratty) and have added it to the corrected Map Exhibit C-3 . <br /> EXHIBIT D - Mining Plan (Rule 6.4.4): <br /> 44. In response to Adequacy Item#12, the Applicant submitted a new and complete Exhibit <br /> D in accordance with Rule 6.4.4. The Division has reviewed the new submittal and <br /> provides the following inadequacies. <br /> I revised Exhibit D page 4 (Revised 11/13/17) to add the information <br /> requested in Items 44 . 1, 44 . 2 and 44 . 3 and supplied a copy for <br /> the file . I also made some revisions to the sloping plan taking <br /> the highwall out until we can complete a stability analysis that <br /> shows leaving the near vertical faces will be safe . Once that is <br /> done, and proving that they will be stable if left in that <br /> configuration a Technical Revision with a bond reevaluation will <br /> be filed with the Division to allow for this option. <br /> 44.1 As required by Rule 6.4.4(f)(ii), please provide information on the nature of the stratum <br /> immediately beneath the material to be mined. <br />
