C O L O R A D O John W. Hickenlooper
Governor
Division of Water Resources
Dep3r,mer,'of PJa'ral Fe,ourcr_ Robert Randall
Executive Director
Kevin G. Rein, P.E.
Director/State Engineer
Response to Reclamation Permit Amendment Application Consideration
DATE: December 13, 2017
TO: Eric Scott, Environmental Protection Specialist
CC: Division 1 Office, District 2 Water Commissioner
FROM: loana Comaniciu, P.E.
RE: Lupton Meadows Gravel Mine, File No. M-2016-076-AM1
Operator: Bestway Concrete Company
Contact: Mark Johnson, (970) 587-7277
Section 13, Twp 2 North, Rng 67 West, 6th P.M., Weld County
CONDITIONS FOR APPROVAL
COMMENTS: The applicant has requested to add 4.1 acres to the existing 96 permitted acres, for a total of
100.1 permitted acres. As previously permitted the mining operation will consume water by evaporation,
dust control, reclamation, water removed in the mined product, dewatering and processing. As noted in our
previous letter November 23, 2016 prior to initiation of these uses of ground water, the applicant will need to
obtain either a gravel pit or other type of well permit, as applicable. However, prior to obtaining a permit,
an approved water supply plan or decreed plan for augmentation is required.
According to our records a SWSP for the site was obtained on February 24, 2017. The SWSP is valid for the
period of March 1, 2017 through February 28, 2019. The SWSP covers the evaporation from a 3 acre exposed
surface area, dust control and water lost with the mine product associated with 500,000 tons/year. Also well
permit no. 80683-F was obtained for the current use and exposed surface area at the Lupton Meadows site in
accordance with §37-90-137(2) and (11), C.R.S. So long as the amended Lupton Meadows Gravel Mine is
operated in accordance with an approved SWSP or approved plan for augmentation, this office has no
objection to the request.
Any storm water runoff intercepted by this operation that is not diverted or captured in priority must
infiltrate into the ground or be released to the stream system within 72 hours. Otherwise, the operator will
be required to make replacements for evaporation.
The applicant may contact the State Engineer's Office with any questions.
.OF CO<rj
Office of the State Engineer .t
1313 Sherman Street, Room 821, Denver, CO 80203 P 303.866,3581
www.water.state.cc.us * '
1876
