Colorado 80203 Mining & Safety <br />Re: New Horizon lune (Perrmt No. C-1981-008) Permit Renewal Apphcation No. 7 (RN -7) (HC <br />1167 1-09) <br />Dear Mr. Bowles: <br />We received \ our correspondence dated November 27, 2017 on November 29, 2017 initiating <br />consultation with our office under Section 106 of the National l listoric Preservation Act (Section 106) <br />for the above referenced undertaking. <br />As the above referenced permit revision does not propose additional surface disturbance outside of the <br />currently- approved area for disturbance, it is our opinion that a finding of no historic properties affected <br />is appropriate for the proposed undertaking pursuant to 36 CFR 800.4(d)(1). <br />Should unidentified archaeological resources be discovered in the course of the project, work must <br />be interrupted until the resources have been evaluated in terms of the National Register eligibility <br />criteria (36 CFR 60.4) in consultation with our office pursuant to 36 CFR 800.13. ,11so, should the <br />consulted -upon scope of the work change please contact our office for continued consultation under <br />36 CI -R 81i0. <br />We request being involved ui the consultation process with the local government, which as stipulated <br />in 36 CI -R 800.3 is required to be notified of the undertaking, and with other consulting parties. <br />Additional information provided by the local government or consulting parties might cause our <br />office to re-evaluate our chgrbiht-\- and potential effect findings. Plcase note that our compliance <br />letter does riot end the 30-d2N review period provided to other consulting parties. <br />We thank you for the opportunity to comment.
