BEFORE THE MINED LAND RECLAALATION BOARD <br />STATE OF COLORADO <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br />IN THE MATTER OF THE REQUEST TO REINSTATE NOTICE OF <br />INTENT TO CONDUCT PROSPECTING OPERATIONS, File No. P-2014-022 <br />THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br />November 15, 2017 in Denver, Colorado as a consent agenda matter to consider a <br />request to reinstate Notice of Intent to Conduct Prospecting Operations number P- <br />2014-022 ("NOI"), held by Total E&P USA Oil Shale, LLC ("Prospector"). <br />The Board, being fully informed of the facts in the matter, enters the following: <br />FINDINGS OF FACT <br />1. Prospector holds Notice of Intent to Conduct Prospecting Operations <br />number P-2014-022. Located in Section 1, Township 1 South, Range 104 West, 61h <br />P.M. in Rio Blanco County, the NOI site is a 2.41 -acre oil shale prospecting site <br />known as the Preas Exploration Project. <br />2. At its meeting on April 27, 2017, the Board found Prospector in violation <br />of section 34-32-116(4), C.R.S. and Rule 5.6(1) of the Allineral Rules and Regulations <br />of the Colorado Mined Land Reclamation Board for Hard Rock, Metal, and <br />Designated Mining Operations for failure to submit a required annual fee, map, and <br />report. The Board ordered the NOI revoked and the financial warranty for such <br />permit to be subject to forfeiture. The Board issued a written order with these terms. <br />3. As of October 17, 2017, all fees and civil penalties have been paid, and <br />annual reports and maps have been filed. Prospector requested reinstatement of <br />the NOI. <br />4. The Division found that Prospector has complied with all requirements <br />of the NOI and the Division does not oppose reinstating the NOI. <br />5. On October 18, 2017. Prospector agreed to the Division's request that <br />the Board reinstate the NOI. <br />CONCLUSIONS OF LAW <br />6. The Board has jurisdiction over this matter pursuant to the Colorado <br />Mined Land Reclamation Act, Article 32 of Title 34, G.R.S. <br />
