Contractor: <br />JHL Constructors, Inc. <br />7075 S. Alton Way <br />Building H <br />Centennial, CO 80112 <br />A - Dirt <br />B- <br />Owner: <br />Trim Ranches, Inc. <br />9720 County Road M <br />Woodrow CO 80757 <br />1. JHL will pay Owner $2/CY for dirt for JHL's use to build a temporary bypass road and ramps for <br />the bridge. <br />2. JHL will provide a engineered survey to determine final used quantity of dirt that will be used <br />to calculate payment of item 1 above. <br />2. Area that Owner will allow JHL to excavate dirt will be up to 150 yards North, l=ast and West <br />of bridge. <br />3. JHL will acquire a State of Colorado Storm Water Permit. JHL will be responsible for the permit <br />maintenance and close out of the permit. <br />4. JHL will provide all required erosion control measures to meet any state and local regulation <br />S. After the bridge bypass is no longer needed, JHL will remove bypass dirt and soils and place <br />the dirt and soil back into the area which It was removed. JHL will grade all affected areas back <br />to original grade plus or minus 3' of original grade. JHL will seed all affected areas after grading <br />is complete. Seeding will be provided once, with a dry land seed mix acceptable to Owner and <br />will be straw crimped. <br />6. JHL will submit to the State of Colorado a Closeout Application for the Storm Water Permit <br />and provide the permit termination to the Owner for Record. <br />7. JHL will repair any damaged areas caused by JHL and its subcontractors. <br />1. JHL will provide Owner a deposit of $10,000. This deposit will held by the owner until all <br />terms of this Agreement are met. After terms of the Agreement are met per Item A-5, A-6 and <br />A-7 above, Owner will refund JHL the full amount with -in 20 business days. <br />C - Payment <br />1. Payment for use of dirt will be paid by JHL by end of November 2017. <br />2. Owner will be responsible for any taxes associated with payment from JHL to Owner. <br />D - Insurance <br />1. JHL to provide Owner with Insurance certificate noting the Owner as an additional insured. <br />
