RECEIVED <br />DEC 0 8 2017 <br />2 December 2017 DMSION OF RECLAMATION <br />Colorado Division of Reclamation, Mining and Safety MINING AND SAFETy <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Subject: Objection to the Hitch Rack Ranch Quarry, Permit Number M2017-049 <br />Ms. Amy Eschberger: <br />This letter is in response to the application submitted by Transit Mix Concrete Company for a quarry to be located <br />on Hitch Rack Ranch. I own a property located within the Eagles Nest development, which is immediately west of <br />the proposed quarry area. This letter lists my objections to the application. The bullets refer to the relevant section <br />of Colorado Title 34 Mineral Resources, Article 32.5 "Colorado land Reclamation Act for the Extraction of <br />Construction Materials". <br />1) 115 (4) (a) The application is incomplete because it contains numerous inaccuracies and inconsistencies. <br />2) 115 4 d A 1968 EI Paso County court decree determined that Little Turkey Creek Road is an <br />ingress/egress easement for Eagles Nest properties. The proposed mining operation will obstruct that <br />easement and is therefore contrary to Colorado easement law. <br />3) 115 (4)_(e] Little Turkey Creek Road is a permanent man-made structure located within 200 feet of <br />affected lands. The engineering assessment of the road fails to prove that mining operations sholl not <br />damage the road. <br />4) 116 c The application falls to adequately demonstrate that material disposed of within the affected <br />lands will not result in any unauthorized release of pollutants to the surface drainage system. <br />5) 116 d The application fails to adequately demonstrate that there will be no unauthorized release of <br />pollutants to groundwater from any material mined, stored or disposed of within the permit area. <br />6) 116 a The application fails to adequately demonstrate that all refuse will be disposed of in a manner that <br />controls unsightliness or the deleterious effects of such refuse. <br />7) 116 h The application falls to adequately demonstrate that disturbances to the prevailing hydrologic <br />balance of the affected land and of the surrounding area will be minimized. <br />8) 1ILU The application fails to adequately demonstrate that areas outside of the affected land will be <br />protected from slides or damage occurring during the mining operation and reclamation. <br />Sincer ly, <br />Cindy Cockrell <br />Address: 10617 E /v�u1 /%G A ✓e <br />hl e5a, Az fFSZ,91 <br />Phone: 719-393-2096 <br />Email: Cindycockrelll@hotmail.com <br />
