13. Based on information provided in the application, the Division determined that <br />two alluvial valley floors (AVFs) exist near the permit area: <br />a. the Yampa River AVF <br />b. Williams Fork River AVF. <br />The Division finds that the proposed surface coal mining operation will not affect either <br />AVF. For additional specific findings concerning these AVFs, please refer to permit <br />Section B, XVII. <br />14. The Division approved the post -mining land uses of rangeland, wildlife habitat and <br />cropland a s meeting the requirements of Rule 4.16 as per Rule 2.07.6(2)(1). <br />15. Specific approvals have been granted or are proposed. These approvals are addressed in <br />the following Section B 2.07.6(2)(m). <br />16. The Division finds that the activities proposed by the RN7 application will not affect <br />the continued existence of endangered or threatened species or result in the destruction or <br />adverse modification of their critical habitats. No impacts to any listed threatened or <br />endangered species has been observed from past mining activities at the Trapper Mine and <br />none is projected (2.07.6(2)(n)). <br />17. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As <br />of this time, Trapper Mining, Inc. is current in the payment of reclamation fees required by <br />30 CFR Chapter VII, subchapter R (2.07.6(2)(0)). <br />Section B — Findings Required by Rule 4 <br />I. Roads- Rule 4.03 <br />A. Haul Roads <br />Haul roads discussed in permit Section 3.7.2, Vol. III, occur upstream of adequate <br />sediment control facilities (4.03.1 (2)(c)). <br />B. Access Roads <br />Access roads, discussed in permit Section 3.7.3, Vol III, meet requirements of rule <br />(4.03.2(2)(c). <br />II. Support Facilities- Rule 4.04 <br />Support facilities discussed in permit <br />(4.04(6)). <br />III. Hvdrologic Balance -Rule 4.05 <br />Section 3.8, Vol. III, meet requirements of <br />Volume 4 of the Trapper Mine permit application includes an assessment of the <br />probable hydrologic consequences of the proposed mining operation. Each year, <br />Trapper assesses the ongoing impacts to the hydrologic system in its annual <br />hydrologic report submitted as Appendix W of the permit application.
