Response: Please refer to the previous response to Comment 9. <br />2.04.4 - Cultural and Historic Resources Information <br />14) Page 2.04-13 indicates, `A small portion of the mine permit area, expected to experience ground disturbance, <br />is scheduled to undergo the necessary cultural resources investigations to meet SHPO compliance in the spring <br />of 2009. The survey results of the currently un -surveyed portions will be submitted as an amendment to the <br />permit application in the future prior to the conduct of ground disturbing activities. " Exhibit 2.04.4-E2 <br />contains a "limited results cultural resources survey with a cover letter dated July 20, 2009. Is this the survey <br />that Page 2.04-13 is describing? If so, please update the permit text. If not, please supply the results of the <br />survey. <br />Response: The referenced 07/09 survey report fulfills the referenced SHPO compliance requirements. The <br />corresponding permit text has been updated and revised to reference the completed survey and report. Copies of <br />the updated information accompany these responses. <br />2.04.7 - Hydrology Description <br />15) Page 2.04-61 contains a table without a title. The Division believes this should be Table 2.04.7-T4. Please <br />update this page to include a title for the table. <br />Response: The referenced page has been reviewed and revised to address this omission. A copy of the revised <br />table accompanies these responses. <br />2.04.10 - Vegetation Information <br />16) Section 2.04. 10 of the permit does not appear to include an evaluation of potential impacts to rare and <br />endangered plant species as required by Rule 2.04.10(5). Please revise Sections 2.04.10 and 2.05.6(2) of the <br />permit to evaluate any potential impacts to rare and endangered plant species. Also, in Section 2.05.6 of the <br />permit, please explain how PSCM will utilize control measures, management techniques and monitoring <br />methods to protect or enhance any threatened or endangered plant species in accordance with Rule <br />2.05.6(2)(a)(ii). <br />Response: Section 2.04.10 addresses TES plant species under the heading, "Special Status Plant Species <br />Inventory", and references the relevant vegetation inventory reports in Exhibit 2.04.10-E1. This information has <br />been updated to reflect the current TES plant species lists, and Section 2.05.6 has been expanded to address TES <br />plant species. Copies of the updated information accompany these responses. <br />2.04.11- Fish and Wildlife Resources <br />17) The Federal and State listed species of concern (Threatened, Endangered and Candidate) may have changed <br />over the last permit term. Please update Table 2.04.11-T6; Special Status of Fish and Wildlife Species for <br />Routt County, Colorado and the likelihood of Occurrence in the PSCM Area if necessary. If there are any <br />changes, please update permit section 2,04. 11 and the Fish and Wildlife Protection Plan in section 2.05.6 of <br />the permit in accordance with Rule 2.05.6(2)(a)(iii).
