At that time, RGNF officials informed Mr. Hudson that he would need authorization for <br /> motorized use across NFS lands and that if he disregarded this notice that the forest Law <br /> Enforcement Officer would be contacted to issue any necessary tickets. <br /> Under the 1872 General Mining Law, the Forest Service is required to provide reasonable access <br /> to unpatented and patented mining claims. However, in accordance with 36 CFR 228 Subpart A <br /> regulations, the proponent must follow an admOistrative process for authorization to prevent any <br /> unnecessary and undue degradation to National Forest surface resources. Therefore, Mr. <br /> Hudson's actions consisting of un-authorized motorized use and road construction/improvement <br /> on NFS lands is not in compliance with the regulations and I am hereby requesting that this <br /> activity cease immediately until proper approval is obtained. <br /> Additionally, Mr. Hudson must provide the RGNF with a proposed Plan of Operation(FS-2900- <br /> 5; attachment 3)per 36 CFR 228.4 for review, analysis, and approval prior to any operations on <br /> NFS lands. If the RGNF does not receive a Plan of Operations from Mr. Hudson within 30 of <br /> your receipt of this letter, Mr. Hudson will be put into non-compliance. As part of the Plan <br /> process, Mr. Hudson will need to include his permission from the patented claim owner to access <br /> his land, a reclamation plan, confirmation of access across non-NFS lands, and will be required <br /> to post a reclamation bond.
