November 17, 2017 <br /> Page 4 of 6 <br /> <br />CONDITIONS OF APPROVAL <br /> <br />I hereby approve the proposed SWSP in accordance with §37-90-137(11), C.R.S., subject to <br />the following conditions: <br /> <br />1. This SWSP shall be valid for the period of October 1, 2017 through September 30, <br />2018, unless otherwise revoked or superseded by decree. If this plan will not be made <br />absolute by a water court action by the plan’s expiration date, a renewal request must <br />be submitted to this office and the Division 2 Office (please copy Kathy Trask at <br />Kathy.Trask@state.co.us) with the statutory fee (currently $257) by July 2, 2018. <br /> <br />2. Well permit no. 78822-F was obtained for the current use and exposed pond surface <br />area of the gravel pit in accordance with §37-90-137(2) and (11), C.R.S. WDID 1205065 <br />is assigned to the gravel pit structure and should be included in all reporting. <br /> <br />3. The total surface area of the groundwater exposed at the Parkdale Project site must <br />not exceed 4.0 acres during this SWSP period, which will result in a net annual <br />evaporative loss of 11.29 acre-feet (assuming ice cover the months of December, <br />January, and February). <br /> <br />4. The annual amount of water used at the operation shall not exceed 9.20 acre-feet for <br />dust control and the total product mined shall not exceed 570,400 tons (451,100 tons <br />of washed aggregate and 119,300 tons of unwashed material) resulting in 15.03 acre- <br />feet of water lost with the product. <br /> <br />5. Total consumption at the Parkdale Project site must not exceed the aforementioned <br />amounts unless a new SWSP application is made and approved for such. <br /> <br />6. Approval of this SWSP is for the purposes as stated herein. Any additional uses of <br />ground water must first be included in a new SWSP approved by this office. <br /> <br />7. Water used for gravel washing ponds that does not infiltrate within 24 hours may <br />require a new SWSP to include additional acres of exposed surface area subject to <br />evaporation that will require additional replacement under the plan. Field visits by <br />the Water Commissioner may be made to confirm that 3.4 acres of evaporative surface <br />area is appropriate for settling ponds and the gravel washing pond under this plan. <br /> <br />8. All pumping for product washing and dust control shall be measured in compliance <br />with the Amended Rules Governing the Measurement of Tributary Ground Water <br />Diversions Located in the Arkansas River Basin. Please note that the meter test is <br />currently expired for one or more meter(s) used at the site and an Order of the <br />Division Engineer was sent to the owner/operator requiring reverification of the <br />meter accuracy by November 14, 2017. <br /> <br />9. The Applicant shall provide daily accounting (including, but not limited to diversions, <br />depletions, replacement sources, and river calls) on a monthly basis. The accounting <br />must be emailed to the Division Engineer (DNR_Div2groundwater@state.co.us) and the <br />Water Commissioner (Dan.Henrichs@state.co.us) with the subject line “Parkdale <br />Project Gravel Pit SWSP”. Said accounting must be received by the 10th of the month
