Alternative criteria and specifications were not used during the design of access
roads (4.03.2(1)(e)).
2. The landowner has not requested the retention of the access road depicted on
Map Nos. 15-1 and 15-2. Therefore, the access road will be reclaimed
(4.03.2(1)(f)).
3. The Division does not propose to approve the location of a portion of an access
road in the channel of a stream (4.03.2(2)(b)).
4. The Division does not propose to approve access road cut slopes steeper than
1.5H:1 V or 0.25H:1 V (4.03.2(3)(c)(i)).
5. The Division does not propose to approve an access road embankment slope
steeper than 1.35H: IV (4.03.2(3)(d)(viii)).
C. Light -Use Roads
1. The Division does not propose to approve the location of a portion of a light -use
road in the channel of an ephemeral stream with an upstream watershed of at
least one (1) square mile, an intermittent or a perennial stream (4.03.3(2)(b)).
2. The Division does not propose to approve a ford of an intermittent, a perennial or
an ephemeral stream, which drains at least one (1) square mile. Fords willbe
allowed across ephemeral streams with a watershed less than one (1) square mile.
The Division finds that the fords will not affect stream sedimentation or fish,
wildlife, and related values due to light and infrequent use.
3. All but one of the current light -use roads are pre-existing roads and will be
retained after reclamation of the Bowie No. 2 Mine site. Stipulation No. 13,
attached to the proposed decision for Permit Revision No. 6, required, in part, the
submittal of the CDOT road use permit for a light use road that was to be used
for access to the west side of the loadout trackage. However, the temporary light
use road was never constructed and the proposed acreage disturbance was
removed from the permit in Technical Revision No. 31. Two additional light use
roads were approved in Permit Revision No. 7. Both allow access to two new
material storage areas.
II. Support Facilities - Rule 4.04
A. Construction of support facilities will not result in change, destruction or disruption of oil,
gas pipelines or water wells, nor will coal slurry pipelines or railroads be impacted.
Therefore, the Division approved those activities (4.04(6)). A list of approved facilities
may be found in Section 2.05.3(3) of the permit.
III. Hydrologic Balance - Rule 4.05
A. Water Quality Standards and Effluent Limitations
The Division granted approval for small area exemptions from the use of
sediment ponds, due to the limited size of the areas and due to the fact that ponds
26
