PERMIT#:M-1985-129 <br /> INSPECTOR'S INITIALS:PSH <br /> INSPECTION DATE:September 14,2017 <br /> INSPECTION TOPIC:Signs& Markers • <br /> PROBLEM/POSSIBLE VIOLATION: Problem:The affected area boundary markers were missing or incorrectly <br /> placed. This is a problem for failure to maintain boundary markers around the affected area as required by Rule <br /> 3.1.12(2). <br /> CORRECTIVE ACTIONS:The Operator shall conduct a survey and replace the boundary markers in the correct <br /> locations.The Operator shall provide proof to the Division that this has been done by the corrective action date. <br /> CORRECTIVE ACTION DUE DATE: 11/21/17 <br /> OBSERVATIONS <br /> The Elbert County Pit was inspected by Peter Hays with the Division of Reclamation, Mining and Safety <br /> (Division/DRMS)as required by the Transfer of Permit and Succession of Operators process and Rule 1.12. The <br /> site was previously inspected by the Division on June 24, 2014. Mr. Robert Christian and Mrs.Samantha <br /> Christian with Christian Construction, Inc. were present during the inspection. The Succession of Operator <br /> application (SO-05)was approved by the Division on August 8,2017. <br /> The Division is required to recalculate the reclamation bond within 60-days from the date of the succession of <br /> operator transfer approval date. The Division currently holds a reclamation bond in the amount of <br /> $52,500.00. No additional financial warranty is required as part of SO-05 based on the observations from this <br /> inspection. <br /> The site is a 112 construction materials operation permitted for 38.69 acres. The permitted area does not <br /> include 4.60 acres for the access road and a pad area south of the access road where in turns to the <br /> southwest. An additional area of disturbance north of the access road where the road turns is leased to Elbert <br /> County and is included in the permitted area. <br /> As cited as a problem,the boundary markers could not be located during the inspection. The Operator was <br /> aware of the lack of boundary markers and scheduled a survey company to replace the corner markers in mid- <br /> October. The Division will require the Operator to submit proof of the replacement of the boundary markers <br /> by the corrective action date. <br /> Noxious weeds were observed on site during inspection. The observed noxious weeds included; diffuse <br /> knapweed,common mullein and Canada thistle. A noxious weed control and management plan has not been <br /> approved for the site. As cited as a problem,the Operator shall develop a weed control and management plan <br /> in accordance with Rule 3.1.10(6). The plan should be developed in consultation with the county extension <br /> agency,or weed control district office and should include specific control measures to be applied,a schedule <br /> for when control measures will be applied and a post-treatment monitoring plan. This weed control plan shall <br /> be submitted to the Division as a Technical Revision to the approved permit with the appropriate fee of <br /> $216.00 by the corrective action date. <br /> The approved post mining land use for the site is rangeland. Topsoil stockpiles were observed north, <br /> southwest and southeast of the active pit area. The stockpiles were vegetated with mostly annual weeds and <br /> Page 2 of 6 <br />
