ANFO per blast. The following conditions must be cause for detonation under emergency <br />conditions: <br />i. Destruction of damaged or deteriorated explosives or detonators in a safe manner; <br />ii. Disposal of misfires and/or undetonated explosives; <br />iii. Firing of charged holes as soon as practicable after cessation of static electricity or <br />stray current conditions when electrical detonators are used; <br />iv. Firing of charged holes as when weather conditions indicate the existence of an <br />imminent safety hazard; <br />Operator safety or safety considerations for the general public. <br />Width of the east and west haul roads must not exceed 60 ft. The distance from the nearest <br />edge of the road to the modeled receptor exclusion zone fence line must be greater than 100 <br />feet for the haul road on the western boundary of the mine and greater than 117 ft for the haul <br />road on the eastern boundary of the mine. <br />Topsoil handling and hauling must not occur concurrently with overburden or coal handling and <br />hauling. <br />Overburden and coal handling and hauling must be restricted to the hours between 7:00 AM <br />to11:00 PM. <br />Topsoil handling and hauling must be restricted to the hours between 7:00 AM to 11:00 PM with <br />the following activity level restrictions: <br />i. Maximum daily activity level is allowed from April through September: <br />a. not greater than 75% of maximum daily activity level must be allowed in October; <br />b. not greater than 55% of maximum daily activity level must be allowed from <br />November through March. <br />GENERAL TERMS AND CONDITIONS: <br />15. This permit and any attachments must be retained and made available for inspection upon <br />request. The permit may be reissued to a new owner by the Division as provided in Regulation <br />Number 3, Part B, Section 11.13 upon a request for transfer of ownership and the submittal of a <br />revised APEN and the required fee. <br />16. If this permit specifically states that final approval has been granted, then the remainder of <br />this condition is not applicable. Otherwise, the issuance of this construction permit is <br />considered initial approval and does not provide "final" approval for this activity or operation of <br />this source. Final approval of the permit must be secured from the APCD in writing in <br />accordance with the provisions of 25-7-114.5(12)(a) C.R.S. and AQCC Regulation Number 3, <br />Part B, Section III.G. Final approval cannot be granted until the operation or activity <br />commences and has been verified by the APCD as conforming in all respects with the conditions <br />of the permit. Once self -certification of all points has been reviewed and approved by the <br />Division, it will provide written documentation of such final approval. Details for obtaining <br />final approval to operate are located in the Requirements to Self -Certify for Final Approval <br />section of this permit.
