area to protect it . Summit Brick and Tile, understands the
requirement concerning unearthing human remains at the mine .
Colorado Division of Water Resources.
Summit Brick and Tile Company understands the State engineers
requirement for stormwater retention and made a commitment in the
application to not retain it for more then 72 hours . The dust
control water is only used during crushing of the sandstone and
is hauled to the site by the company hired to process the stone .
We will make sure they obtain it form an approved source .
Pueblo County
Summit Brick and Tile is aware that if mining takes place outside
a Non-Conforming Use area that a Special Use permit must be
obtained. Prior to mining outside the Non-Conforming Use area a
permit will be obtained if needed.
Objection Letter from Ron Miller
Summit Brick and Tile has been in contact with Mr. Miller
regarding this objection and feel this can be resolved. Special
consideration, was given when developing the mine to retain the
natural historic drainage patterns across the property. We do
not plan to disturb the major drainages that cross the property,
and will build no earthen dams or other structures that restrict
water from leaving the site . The sloping plan shown on Map
Exhibit F - Reclamation Plan shows that the mined area will be
sloped so the floors, day-light out the sides and the bottoms,
except in Area S, that is relatively flat at this time and has no
major drainage crossing the mined area.
Objection Letter from Frascona, Joiner, Goodman & Greenstein, PC
on behalf of Shelly Stewart-Bullock
Their concerns will be addressed in the order presented in the
objection letter.
I . Daniel and Cheryl Hanratty received the notice at their
"address of record" , on August 7, 2017 and Dan signed for it .
Copies of the Certified Return receipts were delivered to the
Division of Reclamation, Mining and Safety on 9/18/2017 showing
that he was properly noticed.
2
