Summit Brick and Tile Company Fox No 1 Clay Pit
M-1977-219 -Adequacy Response#1 November 13, 2017
provisions apply to any and all structures on the leased area no
matter when they were placed there . While we did not feel it
necessary, Summit Brick and Tile Company mailed Structure
Agreements to ALL structure owners within 200 feet of/or on the
mine site .
40. The Applicant identifies three structures which are categorized as being more than 200
feet from mining operations. Please note, AM-03 currently proposes the new permit
boundary as the affected lands boundary. The Applicant shall demonstrate compliance
with Rule 6.4.19 for all structures located within 200 feet of the affected lands.
This should have read 200 feet of the area where excavation will
take place . While we did not feel it necessary, we mailed
Structure Agreements to ALL structure owners within 200 feet of
or on the mine site .
41. The list of structures in Exhibit S does not include the driveways located on the east side
of Siloam Road. Please update the structure list to include all structures within 200 feet of
the affected lands.
This was corrected. Exhibit S has been corrected and the
driveways were added to Map Exhibits C, C-1, C-2, C-3 & F as well
as the Structure lists on Map Exhibits C, C-1 and C-3 . In
addition, while all structures were shown on the major map
exhibits, we created a new exhibit called Map Exhibit C-3 -
Structures as discussed in item #11 .
42. The Applicant has submitted certified mailing receipts for structure agreements sent to
the structure owners, however, has not submitted any of the necessary documents to
comply with Rule 6.4.19.
Attached are copies of structure agreements received to date . We
have 5 that were returned and the ones returned are highlighted
yellow.
Common sense suggests that if the floor of the mine is above
a structure (like along Siloam Road) or the plan is to stay 200
feet away from a structure and mine at 3 : 1 slopes, that structure
will not be impacted by mining like around the B.
Attached is a slope geotechnical analysis showing that with
the 50 foot dig line setback and a maximum estimated mine depth
18
