<br /> Pursuant to CRS 10-11-123 Notice is hereby given:
<br /> (a)That there is recorded evidence that a mineral estate has been severed,leased,or
<br /> otherwise conveyed from the surface estate and that there is a substantial likelihood that a
<br /> third party holds some or all interest in oil,gas,other minerals,or geothermal energy in the
<br /> property; and
<br /> (b)That such mineral estate may include the right to enter and use the property without the
<br /> surface owner's permission.
<br /> PARCEL NO. 1
<br /> 1. Right of the Proprietor of a vein or lode to extract and remove his ore therefrom,should the same be
<br /> found to penetrate or intersect the premises hereby granted,as reserved in United States Patent
<br /> recorded in Book 28 at Page 168,and in Book 28 at Page 629.
<br /> 2. All rights to any coal or other mineral of any character underlying said land,and the right of ingress
<br /> and egress for the purpose of mining,together with enough of the surface of the same as may be
<br /> necessary for the proper and convenient working of such mineral,as reserved in Patent from the State
<br /> of Colorado,recorded in Book 97 at Page 195.
<br /> 3. All coal,together with the right to prospect for,mine and remove the same,as reserved in United States
<br /> Patent recorded in Book 99 at Page 1.
<br /> 4. Right of way for ditches or canals constructed by the authority of the United States,as reserved in
<br /> United States Patent recorded in Book 28 at Page 629,and in Book 99 at Page 1.
<br /> 5. Terms,agreements,provisions,conditions and obligations as contained in RIGHT OF WAY DEED
<br /> BY AND BETWEEN THE STATE OF COLORADO AND ROUTT COUNTY, COLORADO
<br /> recorded October 9, 1920 in Book 122 at Page 232.
<br /> 6. An undivided Thirty-Three and One-Third percent(33 1/3%)of all oil,gas and other minerals and
<br /> mineral rights,TOGETHER WITH the full and free right to enter upon said premises and use so much
<br /> of the surface thereof as may be reasonably necessary for operating,drilling and marking the
<br /> production,as reserved by Thomas Bosworth Scott and Julia Belle Scott in the Deed to Joseph F.
<br /> Livingston,recorded August 28, 1947 in Book 230 at Page 456,and any and all assignments thereof or
<br /> interests therein.
<br /> 7. Excepting and reserving all coal,oil,gas,minerals and mineral rights to Myrtle B.Frentress in Deed
<br /> recorded March 19, 1965 in Book 321 at Page 21.
<br /> 8. One-Third(1/3)of all oil,gas,gravel,sand and other minerals as conveyed in Deeds recorded in Book
<br /> 678 at Page 2347,and in Book 678 at Page 2348,and in Book 678 at Page 2349,and in Book 737 at
<br /> Page 20,and in Book 737 at Page 167,together with any all all assignments or interests there in.
<br /> 9. Right of Way Easement to Yampa Valley Electric Association from Glenn Frentress recorded March 7,
<br /> 1996 as Reception No.459820.
<br /> 10. Terms,agreements,provisions,conditions and obligations as contained in REQUEST FOR
