October 30, 2017 <br /> Colorado Division of Reclamation, Mining and Safety <br /> Attn: Mr. Elliott Russell <br /> 1313 Sherman St, Rm. 215 <br /> Denver, Colorado 80203 <br /> RE: Request to revise the approved seed mix and a request to import fill material from off- <br /> site, and on to the Grisenti Farms Gravel Pit, File No. M2001-005 <br /> Dear Mr. Russell: <br /> Transit Mix Concrete Co. (TMCC), on behalf of Continental Materials Corporation(CMC), is <br /> seeking approval to import material from off-site for use in its reclamation program. The <br /> material will be used at the Grisenti Farms Gravel Pit, file number M2001-005. According to the <br /> provisions of Rule3.1.5 (9), "If an Operator intends to backfill inert structural fill generated <br /> outside the approved permit area, it is the Operator's responsibility to provide the Office notice <br /> of any proposed backfill activity not identified in the approved Reclamation Plan." <br /> We are also requesting approval to revise the approved seed mix. The existing seed mix is not <br /> preforming as intended. We believe the revised seed mix has a better chance for establishment <br /> based on the characteristics of the substituted plant species. Following the section on off-site <br /> import of material is a justification for the proposed replacement plant species. <br /> Importation of Inert Structural Fill: <br /> • Bonding Adequacy: <br /> We believe the current bonding is adequate. Any imported waste construction material will <br /> be placed onto existing berms, adjacent to areas needing backfilled. This will reduce <br /> possible costs associated with importation of backfill. At present, we believe there is <br /> sufficient overburden on site to achieve the post mining land use. However, having <br /> additional material on site is considered a prudent position for TMCC. Having excess <br /> material on hand can enhance the final reclamation and will add little to the final cost for site <br /> reclamation, versus the cost of being short and having to import additional backfill. <br /> There are some small areas (around 2.0 acres)on the mine site that will need to be brought <br /> up to a slightly higher final grade in order to meet the required two feet above the prevailing <br /> ground water elevation. In addition, there are several small process water ponds which could <br /> be filled with imported waste material. The final grading process will spread the imported <br /> materials as needed. <br /> 1 <br />
