Visible emissions shall not exceed twenty percent (20%) opacity during normal operation of the source. <br />During periods of startup, process modification, or adjustment of control equipment visible emissions <br />shall not exceed 30% opacity for more than six minutes in any sixty consecutive minutes. Opacity shall be <br />measured by EPA Method 9. (Reference: Regulation No. 1, Section II.A.1. & 4.) <br />The source was operating on the day of the inspection. No visible emissions were observed. Without <br />credible evidence to suggest the contrary, the source is in compliance with this condition. <br />The particulate emission control measures listed on the attached page (as approved by the Division) shall <br />be applied to the particulate emission producing sources as required by Regulation No. 1, Section <br />IILD.I.b. <br />The control plan is an attachment on the actual permit, but has been inserted below for reference in <br />this report: <br />Control Measures <br />Phased reclamation and rehabilitation, specified in Permit No. C-80-007 issued by Colorado Division <br />of Reclamation, Mining, and Safety, shall be implemented to minimize emissions of fugitive <br />particulate matter emissions. <br />The source appears to be sequentially reclaiming refuse areas (including building the prep <br />plant on a previous coal refuse pile), and sequentially reclaims old MVB pads. Without evidence <br />to suggest the contrary, source is in compliance. <br />II. The surface of the active working area of the coal refuse stockpiles shall be watered as needed. Water <br />shall be applied to any part of a refuse stockpile subject to vehicular activity. <br />The source utilizes water as necessary to control emissions from refuse stockpiles. Source is in <br />compliance. <br />III. Unpaved haul roads shall be treated with chemical stabilizers per manufacturer's recommendations, <br />and watered as often as needed to control fugitive particulate emissions. <br />The source applies chemical stabilizers (magnesium chloride) to unpaved haul roads once per <br />year, and operates two water trucks for roadways as often as necessary to control emissions. <br />Source is in compliance. <br />IV. Reclamation works and sequential extraction of material shall be initiated to keep the total disturbed <br />areas at any one time to a minimum. <br />The source reclaims MVBs and coal refuse piles as required, and has kept total disturbed areas <br />at any one time to a minimum. Source is in compliance. <br />MCC is in compliance with all Control Measures referenced in this condition. <br />2015 Inspection 18 <br />0510015-INSP-2015 Page 10 of 37 <br />
