Section B - Rule 4
Roads — Rule 4.03
A. Haul Road
The applicant has provided relevant information concerning the pre -1995
constructed haul road at King I that shows the road meets the performance
standards of Rule 4.03.1. The applicant has provided a design of the haul road
for the King II Mine that indicates this road will meet the performance standards
of Rule 4.03.1.
2. The Division proposes to approve the retention of the haul road at the King I
Mine, depicted on Map King I-007, because it is compatible with the approved
post -mining land use, and a request for its retention was submitted by the
landowner. (4.03.1(1)(f)(i)).
B. Access Roads
The landowner has requested the retention of the access/haul road at the King I Mine.
Its retention is compatible with the approved post -mining and historic land use of
agriculture (ranching). Therefore the Division proposes to approve retention of the
access road. (4.03.2(1)(f)).
C. Light -Use Roads
There are no light -use roads at the King Coal Mine.
II. Support Facilities — Rule 4.04
Information on mine support facilities is found in Section 2.05.3 of the permit and is depicted
on Maps King I-007 and King II -007. The landowner has requested in writing that some of
the buildings at the King I Mine remain after reclamation to support his agricultural
operation. Mine support facilities have been designed to prevent damage to fish, wildlife,
and property, and to control and minimize air and water pollution. No support facilities are
proposed for permanent retention at the King II Mine.
Construction of support facilities will not result in damage, destruction, or disruption of oil,
gas, or water wells or pipelines, or utility lines which may pass through the permit area.
Therefore the Division approved those construction activities (4.04(6)).
15
