PERMIT#: M-1977-151 <br /> INSPECTOR'S INITIALS: ECS <br /> INSPECTION DATE: November 1,2017 <br /> provide sufficient information to describe or identify how the operator intends to conduct mining and <br /> reclamation. <br /> CORRECTIVE ACTIONS: The operator shall submit a Technical Revision, with the required $216 revision fee, to <br /> update and clarify the current approved mining/reclamation plan and maps to reflect existing site conditions <br /> (gas and oil facilities, recreational structures, etc.) and proposed on-site activities (RV storage, residential areas) <br /> by the corrective action date. <br /> CORRECTIVE ACTION DUE DATE: 1/01/18 <br /> OBSERVATIONS <br /> This was an inspection conducted by Eric Scott representing the Division of Reclamation Mining and Safety <br /> (DRMS) as part of the Division's routine monitoring program. The site was last inspected by DRMS on <br /> November 15, 2013. DRMS attempted to contact the permittee, Rex Hiner, multiple times by telephone in the <br /> weeks leading up to the inspection, but there was no answer at the number provided, and no way to leave a <br /> message for the permittee. Because the permittee could not be contacted to provide access to the site, this <br /> report summarizes issues identified through records review, satellite photo review, and observation of the site <br /> from adjacent streets (N25th Ave, 0-Street, N23rd Ave, and N16th Ave). This site identification sign was <br /> present and the permit area appeared to be defined by existing fences. No mining activity was observed <br /> during the inspection. <br /> The general configuration of the site, and issues observed during this inspection, are largely unchanged from <br /> those noted in the 2013 inspection. The most significant change noted was the appearance of a large gas/oil <br /> facility structure in the western unmined phase of the permit (circled in red on the attached satellite photo), <br /> and an RV storage area located at the intersection of N23rd Ave and N16th Ave. As noted in the previous <br /> report, and again in this inspection report, a technical revision to update the mining and reclamation plans is <br /> required to document the presence of all additional activities and structures within the permit area. <br /> Also as observed in 2013, and stated on the first page of this inspection report, the permittee will need to <br /> demonstrate that they are in compliance with the requirements of the State Engineer's Office Division of <br /> Water Resources with respect to the long term augmentation of post'81 exposed groundwater acreage. The <br /> 2015 SWSP has been attached to this report with some item relevant to this issue highlighted. A corrective <br /> action date of 1/1/2018 has been given at this time to address the problems noted in this report. <br /> Several areas of the observable shorelines appeared to be far steeper than the 3H:1V required by rule. The <br /> Division will require that all shoreline sloping meet the reclamation standards of Rule 3.1.5(7), which requires <br /> 3H:1V slopes for at least 5 feet above and 10 feet below the expected water line, prior to consideration of any <br /> release request. <br /> No other issues were noted during this inspection. <br /> Page 2 of 3 <br />
