PERMIT#: M-2008-017 <br /> INSPECTOR'S INITIALS: ECS <br /> INSPECTION DATE:November 1,2017 <br /> CORRECTIVE ACTIONS:The operator shall either implement the existing weed control plan, or develop a weed <br /> control and management plan in accordance with Section 3.1.10 (6) of the Rule. This plan should be developed <br /> in consultation with the county extension agency, or weed control district office and should include specific <br /> control measures to be applied, a schedule for when control measures will be applied and a post-treatment <br /> monitoring plan. This weed control plan shall be submitted to the Division as a Technical Revision to the <br /> approved plan with the appropriate Technical Revision fee of$216.00 by the corrective action date. <br /> CORRECTIVE ACTION DUE DATE: 12/04/17 <br /> INSPECTION TOPIC: Signs & Markers <br /> PROBLEM/POSSIBLE VIOLATION: Problem: The mine identification sign was not present per the requirements <br /> of Rule 3.1.12. The affected area boundary markers on the south and east side of the permit area are missing or <br /> incorrectly placed. This is a problem for failure to maintain boundary markers around the affected area as <br /> required by Section 3.1.12(2) of the rule. <br /> CORRECTIVE ACTIONS:The operator must post a sign at the entrance to the mine site which shall be clearly <br /> visible from the access road and specify the following; the name of the operator, indicate that a reclamation <br /> permit for the operation has been issued by the Colorado Mined Land Reclamation Board, and the permit <br /> number. The operator shall conduct a survey and replace the boundary markers in the correct location(s). The <br /> operator shall provide proof to the Division that this has been done by the corrective action date. <br /> CORRECTIVE ACTION DUE DATE: 12/04/17 <br /> OBSERVATIONS <br /> This was a routine monitoring inspection conducted by Eric Scott of DRMS of the Derr Pit (M2008-017). DRMS <br /> met on-site with Kelly Hodge to tour the site. As noted above, the mine site identification sign and permit <br /> boundary markers on the north and east sides of the permit area were missing and will need to be replaced by <br /> the corrective action date (photo 1). At the time of this inspection most of the activity on the site appears to <br /> consist of recycling asphalt and concrete. No excavation was taking place. There was also a crew onsite <br /> preparing to abandon a gas well that is currently located near the center of the permit area. <br /> The most significant issue noted during this inspection is that approximately 10 acres outside of the approved <br /> permit boundary have been impacted by mining related activity along the eastern permit boundary (see <br /> attached map). The northern portion of this out-of-bounds affected area has been excavated to a depth of <br /> approximately ten feet and is currently utilized as equipment storage and repair (photos 3-5). The southern <br /> portion of the out-of-bounds area has piles of various sizes of earth materials/soils and wood waste with <br /> minimal excavation or surficial disturbance (photo 6). As noted on the first page of this report, this matter will <br /> require a hearing before the Mined Land Reclamation Board (MLRB). The schedule and other details for the <br /> MLRB hearing will be provided under a separate document to be sent via certified mail to the operator. <br /> Tamarisk trees were noted in several locations within the permit area. These will need to be eliminated as <br /> they are considered to be a noxious species (photo 2). <br /> No other issues were noted during this inspection. <br /> Page 2 of 4 <br />
