BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br /> IN THE MATTER OF CENTRAL CITY CONSOLIDATED MINING, <br /> PERMIT No. M-1990-041 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br /> September 27, 2017 in Denver, Colorado for a hearing to consider a possible <br /> violation by Central City Consolidated Mining ("Operator") for failure to comply <br /> with the conditions of a Board order, permit number M-1990-041. First Assistant <br /> Attorney General Jeff Fugate, Michael Cunningham, and Wally Erickson appeared <br /> on behalf of the Division of Reclamation, Mining and Safety ("Division"). Chris <br /> Neumann, Esq. appeared on behalf of GS Mining, LLC. Christopher Hayes, Esq. <br /> and George Otten appeared on behalf of Operator. <br /> The Board, having considered the Division of Reclamation, Mining, and <br /> Safety and Central City Consolidated Mining Stipulated Agreement ("Agreement") <br /> and the parties' presentations, and having been otherwise fully informed of the facts <br /> in the matter, hereby states that it agrees with and approves the terms of the <br /> Agreement, and orders the following: <br /> FINDINGS OF FACT <br /> 1. Operator holds a 110(2) permit for a 3.5-acre gold mining and mill <br /> operation located in Section 12, Township 3 South, Range 73 West, 6th Principal <br /> Meridian in Gilpin County, Colorado, permit number M-1990-041. The permit <br /> boundary is comprised of a mine and a mill. The mine is known as the Bates- <br /> Hunter Mine and occupies approximately one acre located between the towns of <br /> Central City and Blackhawk along State Highway 119 and the North Fork of Clear <br /> Creek. The mill, known as the Golden Gilpin Mill, is located approximately one- <br /> half mile from the mine and occupies the remaining two and one-half acres of the <br /> permit boundary. <br /> 2. The Board adopts and incorporates the Background Facts, paragraphs <br /> A through 0, of the Agreement as if set forth fully herein. The Agreement is <br /> attached hereto. <br />
