OBSERVATIONS AND FINDINGS <br />PHASE I <br />No Phase I bond release has been requested with SL -07. <br />PHASE II <br />A Phase II bond release has been requested with SL -07. However, because the site remains permitted <br />with the Division (as part of the New Elk Mine permit) the Division has not evaluated topsoil depths, <br />vegetation cover, contribution of suspended solids to runoff, or other factors as part of the SL -07 <br />application. <br />PHASE III <br />A Phase III bond release has been requested with SL -07. However, because the site remains permitted <br />with the Division (as part of the New Elk Mine permit) the Division has not evaluated contour elevations, <br />re -vegetation success, support of post -mining land uses, protection of the hydrologic balance, or other <br />factors as part of the SL -07 application. <br />Summary and Conclusions <br />The Division has not yet found that NECC has successfully completed all surface coal mining reclamation <br />operations in accordance with the approved reclamation plan. Nor has the Division found that NECC met <br />all requirements of the Act and the Rules. However, because the area in question (the NW -1 vent/fan site) <br />has been incorporated into the New Elk Mine permit, this finding is not necessary for Phase II and Phase <br />III release of the site from the Golden Eagle permit (C-1981-013). <br />Golden Eagle Mine Partial Phase II and III Bond Release (SL -07) <br />Permit Number C-1981-013 Page 5 of 6 <br />
