•
DNR COLORADO
CO Division of Reclamation,
Mining and Safety
Department.)* .'a ,c_i ces
1313 Sherman Street, Room 215
Denver, CO 80203
September 11, 2017
Mr. Levi Kessler
3625 Catalpa Drive
Colorado Springs, CO 80907
Re: Pike National Forest Mining Claims; Permit No. M-2017-038;
Need for State Mine Reclamation Permit
Mr. Kessler,
The Colorado Division of Reclamation, Mining and Safety (Division/DRMS) has specific Rules and
Regulations for Hard Rock, Metal, and Designated Mining Operations, adopted by the Colorado Mined
Land Reclamation Board in January 2015. These rules are in accordance with the Colorado Mined
Land Reclamation Act (Title 34 Article 32). It has come to the attention of the Division that you may
be conducting mineral operations at your claim that requires a mine reclamation permit. The Division
has assigned permit ID number M-2017-038 to your claim. Please reference this Permit ID number on
any correspondence you submit to the Division.
As defined in the Act (34-32-103(8)), "mining operation" means the development or extraction of a
mineral from its natural occurrences on affected land. These activities would need an approved mine
reclamation permit with the Division.
As defined in the Act (34-32-110), any person desiring to conduct limited mining operations may apply
for the expedited processing of a mine reclamation permit under two categories: 110(1)—for
operations on less than five acres; or 110(2)—for operations on less than ten acres. Both categories
limit material extractions to less than 70,000 tons of mineral or overburden or combination of the two
per calendar year.
1313 Sherman Street, Room 215, Denver, Co 80203 P 303.866.3567 F 303.832.8106 http://mining.state.co.us * *J
John W.
