Bowles <br />RECEIVED OCT 2 r, <br />l,.nvironmental Protection SpecialistOCT 2 ; 2017 <br />Division of Reclamation, Muting and Safety 0Cl q A K J 2D11 <br />1313 Sherman Street, Room 215 pivision of Reclamation, <br />Denver, Colorado 80203 Mining & Safety <br />Re: New Horizon Mine (Permit No. C-1981-008) Technical Revision No. 83 (TR -83) Alternate <br />Sediment Control Demonstration (HC #67409) <br />Dear Mr. Bowles: <br />We received your correspondence dated October 11, 2017 on October 17, 2017 initiating consultation <br />with our office under Section 106 of the National Historic Preservation Act (Section 106) for the <br />above referenced undertaking. <br />As the above referenced permit revision does not propose additional surface disturbance outside of the <br />currently approved area for disturbance, it is our opinion that a finding of no historic properties affected <br />is appropriate for the proposed undertaking pursuant to 36 CMZ 800.4(d)(1). <br />Should unidentified archaeological resources be discovered in the course of the project, work must <br />be interrupted until the resources haye been evaluated in terms of the National Register eligibility <br />criteria (36 CFR 60.4) in consultation with our office pursuant to 36 CFR 81)0.13. .-\]so, should the <br />consulted -upon scope of the work change please contact our office for continued consultation under <br />36 C' R 8()0. <br />We request being involved in the consultation process with the local government, which as stipulated <br />in 36 CI^R 800.3 is required to be notified of the undertaking, and writh other consulting parties. <br />_additional information provided by the local government or consulting parties might cause our <br />office to re-evaluate our eligibility and potential effect findings. Please note that our compliance <br />letter does not end the 30 -day review period provided to other consulting parties. <br />We thank you for the opportunity to comment.
