3.4 Lined Impoundment <br /> VRI considers the lined impoundment (i.e., the "EPF") to be fully repaired and re- <br /> certifiable as an EPF, as denoted below in Section 5.0: Certifications. Accordingly, <br /> VRI respectfully seeks Division concurrence and written confirmation of same. <br /> 5.0 CERTIFICATIONS <br /> It is VRI's position that the Hukill Gulch Mill Site EPF has been repaired and fully-restored to re- <br /> certifiable EPF status. As per Hard Rock Rule 7.3, VRI respectfully requests Division acceptance <br /> of the re-certification of the subject Hukill Millsite EPF, on the basis of the following supporting <br /> representations and the documentation attached hereto: <br /> (1) The "Geomembrane Repair Approval" (as provided in Appendix II, hereto), wherein it is <br /> attested by Colorado Lining International, Inc. (an appropriately qualified professional), <br /> that "The geomembrane on this project has been repaired, inspected, and tested in <br /> accordance with industry standards and manufacturer's recommendations"; and, <br /> (2) The certification by an independent, third-party Colorado Registered Professional <br /> Engineer(James M. Beck, P.E.; Colorado Registered Professional Engineer#25393)that: <br /> "The subject liner system has been repaired, inspected, and tested in substantive <br /> conformance with both: <br /> a) industry standards and manufacturer's recommendations; and, <br /> b) a Division-approved Corrective Action Plan, as depicted in Technical Revision No. <br /> 3 and Technical Revision No. 4 to DBMS Permit No. M-2009-076, respectively; <br /> and, more generally in substantive conformance with the requirements of Hard <br /> Rock Metal Mining Rule 7.3 and other relevant portions of the Rule as may be <br /> applicable. <br /> So certified this date (October 11, 2017): 111111111111/yI/1,� <br /> REGisIllz <br /> 393 _ <br /> :c_ <br /> N-A <br /> J me o.
