Based upon the T&K Study, as updated by a March 12, 2010 <br /> substitute water supply plan analysis and consultation with the Colorado Division <br /> of Water Resources, HCU attributable to the irrigation of the 54.7 acres by 2.0 cfs <br /> of the Home Ditch amounts to 60.2 acre-feet per year. Accordingly, Applicant is <br /> entitled to 1.1 AF/Ac per year of HCU credit for the changed uses requested <br /> herein. <br /> CONCLUSIONS OF LAW <br /> 7. The foregoing findings of fact are fully incorporated herein by reference. <br /> 8.' The Division Engineer is lawfully required to administer diversions under the Water <br /> Right which is the subject of this Decree pursuant to Colorado law. <br /> 9. This Court has jurisdiction over these proceedings and over all persons who have <br /> standing to appear, whether they have appeared or not pursuant to C.R.S. §§37-92-203, and 37- <br /> 92-302. <br /> 10. Timely and adequate notice of these proceedings and the matters adjudicated herein has <br /> been given in the manner required by law. <br /> 11.
