EQUITY FUNDING, LLC
5040 Acoma Street
Denver, CO 80216 RECEIVED
(303) 295-1216
SEP 29 2017
September 26, 2017 DIVISION of RECLAMATION
NNW ANQ MFETY
Mr. Jared Ebert
Division of Reclamation Mining and Safety
1313 Sherman St, *215
Denver, CO 80215
Dear Mr. Ebert;
RE: Aggregate Industries, Inc.
Hazeltine Mine - M-2004-031
This letter and the attached photos are an update from my point of view on
Amendment 01 approved by the Mined Land Reclamation Board on November 16,
2016. In that decision, the Board approved the amendment to add 2 pipes thru
their slurry wall to relieve ground water mounding along the east side of their mine.
They said they would have it in and operational within 60 days of the approval. It
is now September 27, 2017 nearly 10.5 months after that approval and it appears
there is still no water passing thru the drain.
This is an update on what I have done to monitor the success of their proposed
mounding mitigation plan and the impact it is having on my property. On January
25, 2017, I installed 3 monitoring well across my property from north to south, at
my cost. Two of the wells were placed as close as we could get the drill equipment
to 2 of the Aggregate Industries wells. Orr-MW-03 was placed southeast of
Aggregate Industries MW-11B and Orr-MW-02 was placed east of Aggregate
Industries MW-2. We began collecting data on a monthly basis and taking pictures
of Aggregate Industries progress on constructing the drain starting on 3/9/17 and
running thru 9/12/17 when the last monitoring well readings were done. As you
will see construction did not end until sometime in late July or early August 2017,
nearly 8.67 months after approval. None of the pictures of the floor area and
carrying ditch show water flowing in it. There is no appearance of water flowing
down the tail race from their pipes to the mine area floor and there is no pump
installed in the reservoir to discharge the water they collect as the state engineer
required. This seems to me to indicate they have not done what they said they
would do again.
I can tell you the ground water elevations in our wells have not changed
substantially since January 2017. So even if they have been operating the drain, it
appears it has made little or no impact on the groundwater elevation on my
property. I also find it interesting, that according to the D.R.M.S. Laserfiche portal
