The property owner operated what F- <br /> is known as Swift Ponds. In spite of a statewide drought, the property owner believed <br /> the level of the ponds were affected by the groundwater changes from mining. <br /> cc <br /> To settle the dispute, CRI agreed to build recharge lakes and established a groundwater N <br /> monitoring plan. <br /> 0 <br /> Connell Resources Inc. submits the following basis of fact for a modification of the 2 <br /> Groundwater Monitoring plan: <br /> • The property was acquired by Colorado Youth Outdoors in 2006. According to <br /> Colorado Youth Outdoors the water levels have not been a concern since they 00 <br /> have owned the property. (For confirmation call Bob Hewson Executive Director <br /> or Rob Anderson Facility Caretaker 970 663-0800) <br /> • Connell Resources Inc. provides it's over allocated water supply to the Swift <br /> Ponds/Colorado Youth Outdoors site through a culvert from the Connellcc <br /> Resources Inc. recharge ponds. <br /> cc <br /> • Once the recharge ponds were fully functional the water levels at the Swift Pond <br /> site stabilized and have never been in question since that time. <br /> CONNELL <br />
