PERMIT#: M-2006-013 <br /> INSPECTOR'S INITIALS: ECS <br /> INSPECTION DATE: September 27,2017 <br /> that some impacts (stockpiled topsoil, etc) are located outside the approved permit boundary, this possible <br /> violation will require a hearing before the Mined Land Reclamation Board. The schedule and other details for <br /> the MLRB hearing will be provided under a separate document to be sent via certified mail to the operator. <br /> CORRECTIVE ACTION DUE DATE: 10/31/17 <br /> INSPECTION TOPIC: Revegetation <br /> PROBLEM/POSSIBLE VIOLATION: Problem: Tamarisk (salt cedar) trees are present within or have volunteered <br /> into the permit area and are becoming established. This is a problem for failure to employ weed control <br /> methods for a state listed noxious weed species within the permitted area, and to reduce the spread of weeds <br /> to nearby areas as required by Section 3.1.10 (6) of the rule. <br /> CORRECTIVE ACTIONS:The operator shall either implement the existing weed control plan, or develop a weed <br /> control and management plan in accordance with Section 3.1.10 (6) of the Rule. This plan should be developed <br /> in consultation with the county extension agency, or weed control district office and should include specific <br /> control measures to be applied, a schedule for when control measures will be applied and a post-treatment <br /> monitoring plan. This weed control plan shall be submitted to the Division as a Technical Revision to the <br /> approved plan with the appropriate Technical Revision fee of$216.00 by the corrective action date. <br /> CORRECTIVE ACTION DUE DATE: 10/31/17 <br /> INSPECTION TOPIC: Gen. Compliance With Mine Plan <br /> PROBLEM/POSSIBLE VIOLATION: Problem: Rule 1.13.5 states, if an Operator temporarily ceases production of <br /> the mining operation for one hundred eighty (180) days or more, the Operator must file a Notice of Temporary <br /> Cessation in writing to the Office. <br /> CORRECTIVE ACTIONS:The Division is therefore requiring the permittee to file a Notice of Temporary Cessation <br /> in writing to the Office that complies with the requirements of Rule 1.13.5(2) by no later than October 31, 2107, <br /> or resume mining or reclamation activities as appropriate at this site.The start date of the initial 5 year <br /> Temporary Cessation period is retroactive to the last date the pit was active. If that date is more than 5 years <br /> ago, the operator is required ask the Board for a 5 year extension to the Temporary Cessation period (per rule <br /> 1.13.5 (3) and 1.13.8 (b) or begin reclamation. <br /> CORRECTIVE ACTION DUE DATE: 10/31/17 <br /> OBSERVATIONS <br /> This routine monitoring inspection of the Potts Pitt#2 site was conducted by Eric Scott of DRMS who was <br /> accompanied by David King representing Eastern Colorado Aggregates/Kirkland Construction. This 49 acre site <br /> lies approximately 7 miles northeast of Walsenburg in Huerfano County. The site is split into three phases, <br /> and it appears that activity has been largely confined to Phase 1 at this time (see attached map). No mining <br /> activity or equipment was present on site during the inspection. Cattle were observed grazing on the <br /> property. Photos of representative site conditions/issues have been attached to this report. As outlined in <br /> the previous section of this report, several issues were observed that will need to be resolved including: sign <br /> and markers replacement, elimination of Tamarisk, and resolution of possible off-site impacts. Based on the <br /> establishment of native vegetation at this site, it appears that it has been at least several years since the site <br /> has been active. DRMS therefore requires that the site be placed into temporary cessation status as detailed <br /> above, or that mining or reclamation activities recommence as appropriate. <br /> No other issues were identified during this inspection. <br /> Page 2 of 4 <br />
