RECEIVED <br /> September 19, 2017 SEP 2 2 2017 <br /> DIVI"OF RECLAMATION <br /> Colorado Division of Reclamation, Mining and Safety MINING AND SAFETy <br /> Attn: Mr. Elliott Russell <br /> 1313 Sherman St, Rm. 215 <br /> Denver, Colorado 80203 <br /> RE: Notice and Request to import fill material from off-site, and in to the Pueblo East Pit, File <br /> No. M1986-015 <br /> Dear Mr. Russell: <br /> Transit Mix Concrete Co. (TMCC) on behalf of Continental Materials Corporation(CMC) <br /> proposes to import material from off-site for use in its reclamation program. The material will <br /> be used at the Pueblo East Pit, File Number M1986-015. According to the provisions of <br /> Rule3.1.5 (9), "If an Operator intends to backfill inert structural fill generated outside the <br /> approved permit area, it is the Operator's responsibility to provide the Office notice of any <br /> proposed backfill activity not identified in the approved Reclamation Plan." <br /> • Bonding Adequacy: <br /> We believe the current bond is adequate. Any imported construction waste material will be <br /> placed into mined out pits and other areas currently receiving waste processing fines. At <br /> present, we believe there will be sufficient processing fines to backfill excavated pits and <br /> achieve the post mining land use. Having additional material on site, however, is considered <br /> a prudent position for TMCC. Having excess material on hand will help ensure there will be <br /> no additional cost for importation of backfill. <br /> Imported construction waste material will be placed into excavated pits and other areas now <br /> receiving processing fines. Final grading will spread the imported materials and processing <br /> fines once an area reaches the intended topographic elevation. No extra grading will be <br /> required. We believe importing waste construction material will be cost neutral and <br /> therefore an increase to the reclamation bond is not needed. <br /> Given the proximity of ground water to the operation(Pits Phase 1 and Phase 7), only aged <br /> concrete material will be disposed of onsite. <br /> • Pueblo East Pit Notice: <br /> The Notice shall include, at a minimum, the following information, Rule 3.1.5(9): <br /> 1 <br />
