September 19, 2017 <br /> Colorado Division of Reclamation, Mining and Safety <br /> Attn: Mr.Tim Cazier <br /> 1313 Sherman St,Rm. 215 <br /> Denver, Colorado 80203 <br /> RE: Notice and Request to import fill material from off-site, and on to the Daniel's Sand Pit#2,File <br /> No. M1973-007 SG (the East Pit Area) <br /> Dear Mr. Cazier: <br /> Transit Mix Concrete Co. (TMCC)on behalf of Continental Materials Corporation(CMC)proposes to <br /> import material from off-site for use in its reclamation program. The material will be used at the Daniel's <br /> Sand Pit#2, file number M1973-007 SG(the East Pit Area). According to the provisions of Rule3.1.5 <br /> (9), "If an Operator intends to backfill inert structural fill generated outside the approved permit area, it is <br /> the Operator's responsibility to provide the Office notice of any proposed backfill activity not identified <br /> in the approved Reclamation Plan." <br /> • Bonding Adequacy: <br /> Given the bond for the operation already includes this same activity in the West Pit Area, and the West Pit <br /> Area is not likely to receive any additional offsite materials, other than processing waste sand from <br /> TMCC processing facility, the current bond should be sufficient. In addition, material received from <br /> offsite sources will be clean construction waste material and locally derived silica sand slurry wash <br /> material. These materials delivered to the site will not result in any additional cost. They may actually <br /> decrease the cost of reclamation by raising the floor of the mined out pit. Material placed along slopes or <br /> high walls will also reduce the amount of backfill grading needed to achieve the desired 3H:V final <br /> slopes. <br /> Importation of offsite waste construction materials was previously approved for the Daniel's Pit,West Pit <br /> Area. The approval was granted as part of the 1992 Permit Amendment, and may be found in Exhibit E, <br /> Page E-3. Certain provisions of the 1992 Amendment(provided below)are requested to be incorporated <br /> into the approved permit for the Daniel's Sand Pit#2, (the East Pit Area). <br /> • 1992 Amendment, File No.M1973-007 SG: <br /> "Pit Bottom:The pit bottom currently is a series of basins and depressions that serve various purposes in <br /> the mining process. By backfilling these depressions, the pit bottom will be converted into a <br /> gentle...slopes...nearly level." <br /> "The backfilling process will be done with a variety of materials. These include primarily waste materials <br /> produced by the processing of the sand, but will also include clean construction wastes. Clean <br /> construction waste include, for the purposes of this permit, ..., bricks, fill dirt and other non-organic <br /> materials derived from this operation or hauled into the site by other parties for disposal from various <br /> construction sites." <br /> 1 <br />
