Wein <br />Environmental Protection Specialist SEP 2 2 20i7 <br />llivision of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 OF RECLAMATION <br />Denver, Colorado 80203 DIVISION <br />MINING AND SAFETY <br />SEP 2 0 2017 <br />Re: Bowie No. 2 Mine (Permit No. C-1996-083) Technical Revision No. 114 (TR -111) Revise <br />Underdrain Location (HC #67452) <br />I)ear Mr. Wein: <br />We received your correspondence dated September 5, 2017 on September 7, 2017 initiating consultation <br />with our office under Section 106 of the National Historic Preservation Act (Section 106) for the <br />above referenced undertaking. <br />.\s the above referenced pen -nit revision does not propose additional surface disturbance outside of the <br />currently approved area for dist-urbance, it is our opinion that a finding of no historic properties affected <br />is appropriate for the proposed undertaking pursuant to 36 C1�R 800.4(d)(1). <br />Should unidentified archaeological resources be discovered tri the course of the project, work must <br />he itucrrupted until the resources have been evaluated in terms of the National Register eligibtlit\ <br />criteria (36 CFR 60.4) in consultation with our office pursuant to 36 CFR 800.13. also, should the <br />consulted -upon scope of the work change please contact our office for continued consultation under <br />36 CFR 800. <br />We request being involved in the consultation process with the local government, which as stipulated <br />in 36 CFR 800.3 is required to be notified of the undertaking, and with other consulting parties. <br />_Additional information provided by the local government or consulting parties might cause our <br />office to re-evaluate our eligibility and potential effect findings. Please note that our compliance <br />letter does riot end the 30 -day review period provided to other consulting parties. <br />We thank you for the opportunity to comment.
