i <br /> 13. The Application described a placer mining operation with on-site <br /> processing. Recovery of placer gold will be accomplished by processing mined material <br /> through a wash plant with a hopper, trommel screen and a sluice. Placer gold is the <br /> primary commodity mined. Sand and gravel will be sold as secondary commodities. <br /> The permit boundary encompasses 41.4 acres. 10f the 41.4 acres,the mining operation is <br /> anticipated to affect a maximum area of 12 acres at any given time. Applicant <br /> committed to concurrent reclamation to limit t} e area of disturbance. Affected lands <br /> will be reclaimed to support rangeland past-m ning land use. The Division calculated <br /> the required financial warranty amount for the operation to be $153,640. <br /> 14. The Application adequately demonstrated that any disturbances to the <br /> prevailing hydrologic balance of the proposed affected land and surrounding area, <br /> including both surface water and groundwater, will be minimized. At the hearing,the <br /> Division testified that Applicant committed to obtaining a Storm Water Discharge <br /> Permit from the Water Quality Control Division of the Colorado Department of Public <br /> Health and Environment(Exhibit M of the Application) and the Application addressed <br /> best management practices (including earthen berms, silt fencing, mining at least one <br /> hundred feet of the Platte River, mining outside of the one hundred year floodplain, and <br /> water level monitoring in process ponds)to control erosion and prevent sediment <br /> transport to undisturbed areas. <br /> 15. The Application adequately demonstrated that all aspects of the mining and <br /> reclamation plan take into account the safety and protection of wildlife on the mine site. <br /> At the hearing, the Division testified that the Application addresses impacts to aquatic <br /> species by restricting mining and reclamation to areas located outside of the one hundred <br /> year floodplain and no closer than within one hundred feet of the banks of the Platte <br /> River; the Application addresses the reclamation of eight acres of land which do not <br /> currently exhibit topsoil or vegetation; and Applicant provided a commitment to work <br /> with CPW to incorporate its recommendations. <br /> 16. Applicant complied with the conditions of the February 2017 Order, <br /> including timely payment of civil penalties and compliance will all corrective actions. <br /> 17. At the hearing,the Division testified that no additional violations have been <br /> found against Applicant. In addition, an email from Park County was offered and <br /> admitted into the administrative record stating,among other things: "This email is to <br /> confirm that the land use/zoning issue referenced in the County's March 21,June8, and <br /> June 22, 2017, letters have been addressed." <br /> 18. No portion of the mining operation is in conflict with the laws or regulations <br /> of this state, including Park County zoning regulations. <br /> CONCLUSIONS OF LAW <br /> 19.
