BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OFI LAW,AND ORDER <br /> IN THE MATTER OF THE APPLICATION OF IGH SPEED MINING, LLC FOR 112C <br /> CONSTRUCTION MATERIALS RECLAMATION PERMIT, <br /> File No. M-1991-037 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br /> August 23, 2017 in Denver for a hearing to consider the application for a 112c <br /> construction materials reclamation permit filed by High Speed Mining, LLC <br /> ("Applicant"),file number M-1991-037. Michael Cunningham,Tony Waldron, and <br /> First Assistant Attorney General Jeff Fugate appeared on behalf of the Division of <br /> Reclamation, Mining and Safety("Division"). Ben Langenfeld, P.E. of Greg Lewicki <br /> and Associates, PLLC and Lance Baller appeared on behalf of Applicant. Objector Ann <br /> Lukacs ("Ms. Lukacs") appeared on her own behalf. <br /> The Board,having considered the presentations,testimony, and evidence of the <br /> Division,;Applicant; and Ms. Lukacs, and bein otherwise fully informed of the facts in <br /> the matter, enters the following: <br /> FINDINGS OF FACT <br /> I <br /> 1. Applicant holds a 11oc reclamation permit for an 8-acre gravel and gold <br /> mining operation located in Section 33, Township 9 South, Range 77 West, 6tb Principal <br /> Meridian,Park County. The site is known as the Katuska Pit. Applicant owns the land <br /> on which the site is located. <br /> 2. At its January 25, 2017 meeting,the Board held a hearing to consider <br /> possible violations by Applicant for mining approximately 2.4 acres of land outside the <br /> permit boundary. The Board found that, by mining two or more acres outside the <br /> approved boundary,Applicant engaged in a new mining operation without first <br /> obtaining a permit, in violation of section 34-32,109(1), C.R.S. Among other things,the <br /> Board ordered Applicant to submit an application to convert the 11oc Construction <br /> Materials permit to a 112 Hard Rock reclamation permit. The Board issued a written <br /> order, effective February 9, 2017("February 2017 Order"). <br /> 3. On March 28, 2017,Applicant filed a conversion application with the <br /> Division to convert the 11oc Construction Materials permit to a 112 Hard Rock <br /> reclamation permit and change the name of the site to the Fairplay Au Pit <br /> ("Application"). <br /> 'The Division was advisory staff to the Board,not a party,in this proceeding. <br />
