TR70 proposes to reduce the permit area boundary by 184.50
acres. All reclaimed lands within this parcel have received final, Phase III, bond release. All
mining related disturbances within this parcel have been reclaimed, unless previously approved as
permanent features.

The Divisions records show that the current permit area contains 306.4 acres that have been affected
by mining. TR70 proposes to reduce the affected acreage by 4.0 acres. The remaining affected
acres will be 302.4 acres after TR70 approval. Table 3-7 submitted with the TR70 application
reports this value as 300.9 acres.

Please correct the affected acres value on Table 3-7, or provide an explanation for the 1.5 acre
difference between Snowcap Coal Company’s record and the Division’s value.

If you have questions or need additional information, please contact me.
